Welcome to Den Hoggen Armenia! The terms "we", "us" and "our" refer to our brand.

We operate this online store and website, including all related information, content, products and services, in order to provide you, our customers, with the best possible shopping experience (the "Services"). Den Hoggen Armenia is operated by "LIBO GROUP" LLC, a company registered in the Republic of Armenia. Our platform is powered by Shopify, which helps us provide you with high-quality service.

These terms and conditions (the "Terms of Service" or "Terms") set out your rights and responsibilities when you use our Services. By visiting our website and using the Services, you agree to these Terms and to our Privacy Policy.

1. Access and account

By agreeing to these Terms, you confirm that you are of legal age in your place of residence or, as an adult, that you consent to minor members of your household using our Services on devices you own or control.

When using our online store and purchasing products, you may need to provide certain information such as your email address and payment and delivery details. You confirm that all information you provide is accurate, current and complete, and that you have the right to use it.

You are personally responsible for the security of your account details and for all activity on your account. You may not transfer, sell or entrust your account to anyone else.

2. Our products

We make every effort to present the products and services in our online store as accurately as possible. However, colours and product images may differ slightly from reality depending on your screen's characteristics, settings and configuration.

We cannot guarantee that the quality or appearance of any product or service you purchase will fully meet your expectations or look exactly as shown in the photos in our online store.

All product descriptions are subject to change at any time without notice, at our discretion. We reserve the right to discontinue any product at any time, or to limit the quantities of any product supplied to any person, geographic region or jurisdiction on a case-by-case basis.

3. Orders

When you place an order, you are making an offer to purchase the product. Den Hoggen Armenia reserves the right to accept or decline your order at its discretion and for any reason. Your order is not accepted until Den Hoggen Armenia confirms it. Payment must be successfully received and processed before your order is finally confirmed.

Please check all details carefully before submitting your order, as we may not be able to accommodate cancellation requests once it has been confirmed. If we do not accept, change or cancel your order, we will try to notify you using the email address, postal address and/or phone number provided when the order was placed.

Returns and exchanges of purchased products are handled strictly in accordance with our Refund Policy.

You confirm and warrant that you are purchasing products for personal or household use only and not for commercial resale or export.

4. Prices and payment

Prices, discounts and special offers may change without notice. You will be charged the price in effect at the time your order is placed, as also shown in your order confirmation email. Unless otherwise stated, prices displayed on the website do not include taxes, shipping, handling, customs or import charges.

Prices in our online store may differ from prices in physical stores or on other online platforms operated by third parties. From time to time we may offer promotions that affect prices; in that case the terms of the specific promotion apply. If there is a conflict between the terms of a promotion and these Terms, the promotion terms prevail.

You agree to provide current, complete and accurate purchase, payment and account information for every purchase made in our store. You agree to promptly update your account and other information (including your email address and payment card numbers and expiry dates) so that we can complete your transactions and contact you as needed.

You confirm and warrant that:

(i) the payment card details you provide are genuine, accurate and complete;
(ii) you are fully authorised to use that card for the purchase;
(iii) your transactions will be honoured by your card issuer;
(iv) you will pay the charges incurred at the prices shown on the website, including any applicable delivery, handling and tax charges.

5. Shipping and delivery

We are not responsible for delays arising during shipping and delivery. All delivery times are estimates only and are not guaranteed. We are not liable for delays caused by courier companies, customs procedures or events beyond our control (force majeure).

6. Intellectual property

Our Services, including but not limited to all trademarks, brands, text, designs, images, graphics, product reviews, video and audio materials, and their arrangement and presentation, are the property of Den Hoggen Armenia, its partners or licensors. They are protected by copyright, patent and other applicable local and international intellectual property laws.

These Terms permit you to use our Services for personal, non-commercial purposes only. Without our prior written consent, it is strictly prohibited to reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or otherwise transmit any material on our platform.

Except as expressly stated here, these Terms do not grant you any licence or right in any patent, trademark, copyright or other intellectual property of Den Hoggen Armenia, Shopify or any third party. Unauthorised use of the Services is a breach of law. All rights not expressly granted here are reserved by Den Hoggen Armenia.

Den Hoggen Armenia names, logos, product and service names, designs and slogans are trademarks of us, our partners or licensors and may not be used without our prior written permission. The Shopify name, logo and related designs belong to Shopify. All other names, logos and slogans on our site are the property of their respective owners.

7. Optional tools

Within our Services you may be given access to additional tools offered by third parties, which we neither monitor nor control.

You acknowledge and agree that such tools are provided "as is" and "as available", without any warranties, representations, conditions or support. We accept no liability for any result arising from the use of third-party tools.

Any use of optional tools offered on the site is entirely at your own risk and discretion. We recommend that you review and agree to the terms on which the relevant third-party provider offers them.

In the future we may offer new features or services (including new tools and resources). Any such new feature will automatically be part of our Services and subject to these Terms.

Our Services may contain materials and links to websites provided or operated by third parties (including features embedded in the site). We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites. 9. Relationship with Shopify

Den Hoggen Armenia is powered by Shopify, which enables us to provide the Services to you. However, any purchase or sale made in our store is made directly between you and Den Hoggen Armenia.

By using our Services, you acknowledge and agree that Shopify is not responsible for any aspect of transactions between you and Den Hoggen Armenia, including but not limited to any injury, damage or loss resulting from purchased products and services.

You hereby fully release Shopify and its affiliates from any claims, damages or liabilities arising out of or relating to your purchases and transactions with Den Hoggen Armenia.

10. Privacy

All personal information we collect through the Services is subject to our Privacy Policy. Certain information may also be subject to Shopify's Privacy Policy. By using our Services, you confirm that you have read and understood these documents.

Because our store is hosted on Shopify, Shopify collects and processes information about how you use our site in order to develop and improve the Services provided to you.

To provide the Services properly, the information you provide may be transferred to and shared with Shopify and our partner companies (third parties), which may operate outside your country of residence.

If you share, upload, post, email or otherwise send us ideas, suggestions, feedback, reviews, plans or other content, you grant us a perpetual, worldwide, sublicensable, royalty-free right to use, reproduce, modify, publish, distribute and display that content in any media and for any purpose (including commercial purposes), for example to operate, improve, evaluate and promote our Services and to exercise our rights and perform our obligations under these Terms.

You also confirm and warrant that:

(i) you own or have all necessary rights to the feedback you provide;
(ii) you have disclosed any compensation or incentive received in exchange for the review or feedback;
(iii) your feedback fully complies with these Terms.

We are not and shall not be obliged to (1) keep your feedback confidential; (2) pay compensation for it; or (3) respond to your comments or reviews.

We reserve the right (but not the obligation) to review, edit or remove, at our discretion, content we consider unlawful, offensive, threatening, defamatory, pornographic, obscene or otherwise objectionable, or that infringes any party's intellectual property or these Terms.

You agree that your reviews and feedback will not violate the rights of any third party, including copyright, trademark, privacy, personality or other proprietary rights; will not be defamatory, unlawful, abusive or obscene; and will not contain computer viruses or other malware that could in any way affect the operation of the Services or related websites.

You may not use a false email address, impersonate anyone, or mislead us or third parties about the origin of any feedback. You are solely responsible for any review you post and its accuracy. We take no responsibility for reviews posted by you or any third party.

12. Errors, inaccuracies and omissions

Occasionally, information on our site or in the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, offers, shipping charges, delivery times and availability.

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information on the site is inaccurate, at any time and without prior notice (including after you have submitted your order).

13. Prohibited uses

You may use the Services only for lawful purposes. You may not access or use the Services, directly or indirectly:

(a) for any unlawful or malicious purpose;

(d) to harass, abuse, intimidate, defame or harm our employees or any other person;

(g) to send advertising or promotional material, including "spam", "chain letters" or similar unsolicited messages;
(h) to impersonate (or attempt to impersonate) another person or company;
(i) to engage in any conduct that restricts others' use of the Services or that, in our judgement, may harm Den Hoggen Armenia, Shopify or our customers or expose them to liability.

In addition, you agree not to:

(a) upload or transmit viruses or any other malicious code that may affect the operation of the Services;
(b) reproduce, copy, extract, sell, resell or otherwise exploit any part of the Services;
(c) collect or track the personal information of others;
(d) spam, phish, pharm or otherwise use the Services for fraudulent purposes;
(e) use robots, spiders, scraping tools, artificial intelligence (such as agentic AI) or other automated or manual means to access the Services, except as permitted in section 14;
(f) circumvent or interfere with our security or authentication systems, robot-limiting mechanisms or other protective measures.

We reserve the right to suspend, restrict or terminate your account at any time and without notice if we determine that you have breached any part of these Terms.

14. Agents (automated programs)

14.1 This section (the "Agent Terms") applies if you use, operate or facilitate the use of an "agent" to access our Services. An "Agent" means any software or service that acts autonomously or semi-autonomously on behalf of or at the direction of a person or company and that can operate using a user's device without direct supervision.

14.2 An Agent may not use our Services unless it consistently identifies itself and acts in strict compliance with section 14.4 below. In addition, an Agent may not access the Services if we ask it to refrain from interacting with a particular service.

14.3 We reserve the right to restrict (including by technical means) how and whether any Agent may interact with our Services.

14.4 Agents must:

(i) identify in every HTTP/HTTPS request that the request comes from an agent, stating the agent's name in the request's User Agent string as follows: Agent/[agent name];
(ii) not hide or disguise their actions, for example (a) by simulating human behaviour or (b) by completing or circumventing a CAPTCHA (or any other system designed to distinguish humans from computers);
(iii) answer truthfully any question intended to determine whether a human or a computer is acting at a given moment;
(iv) not circumvent measures designed to block, restrict or control the actions of agents.

15. Termination

We reserve the right, at our discretion, to terminate this agreement or restrict your access to the Services (or any part of them) at any time and without notice. In that case you remain liable for all amounts due up to and including the date of termination.

The following sections survive termination: Intellectual property, Reviews and feedback, Termination, Disclaimer of warranties, Limitation of liability, Indemnification, Severability, Waiver, Entire agreement, Assignment, Governing law, Privacy, and any other provision that by its nature should survive termination.

16. Disclaimer of warranties

Information presented on or through our Services is for general information purposes only. We do not warrant the accuracy, completeness or usefulness of this information, and any decision you make based on it is at your own risk. We disclaim all liability arising from reliance on these materials by you, any other visitor or anyone informed of their contents.

Except as expressly stated by Den Hoggen Armenia, the Services and all products offered through them are provided "AS IS" and "AS AVAILABLE". We make no additional representations, conditions or warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title and non-infringement. We do not warrant that your use of the Services will be uninterrupted, timely, secure or error-free.

17. Limitation of liability and indemnification

To the fullest extent permitted by law, in no event shall Den Hoggen Armenia, our partners, directors, officers, employees, subsidiaries, agents, contractors, service providers or licensors, nor Shopify and its affiliates, be liable for any injury, loss, claim or any direct, indirect, incidental, punitive or special damages, including without limitation:

lost profits;
lost revenue;
lost savings;
loss of data;
replacement costs and similar damages,

whether based in contract, tort (including negligence) or any other legal theory, arising from your use of the Services or our products.

This limitation also applies to any claim related in any way to your use of the Services or any product, including but not limited to errors or omissions in any content, or any loss or damage incurred as a result of the use of the Services or any content (or product) posted, transmitted or otherwise made available through them, even if we were advised of the possibility of such damage.

You agree to defend, indemnify and hold harmless Den Hoggen Armenia, Shopify, our subsidiaries, affiliates, officers, directors, employees, agents, contractors, licensors and service providers from any loss, damage, liability or claim (including reasonable attorneys' fees) made by any third party arising from:

(1) your breach of these Terms (or any documents referred to in them);
(2) your violation of any law or the rights of any third party;
(3) your use of our Services.

We will notify you of any such claim. A delay in notification does not relieve you of your obligations (unless the delay materially prejudices you). We reserve the right, at your expense, to control the defence and settlement of any claim (including the choice of counsel), but we will not settle any claim requiring you to perform non-monetary obligations without your prior consent. You agree to cooperate in the defence and provide relevant documentation as needed.

18. Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall nevertheless be enforced to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such a determination shall not affect the validity and enforceability of the remaining provisions, which remain in full force.

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

These Terms, together with any policies or operating rules posted on our site or in connection with the Services, constitute the entire agreement between you and us. They govern your use of the Services and supersede all prior or contemporaneous agreements, communications and proposals, oral or written (including any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party (us).

You may not assign, transfer or delegate this agreement or any of your rights or obligations under these Terms without our prior written consent. Any such attempt is void and has no legal effect.

We may assign, transfer or delegate these Terms and our rights and obligations to third parties at any time without your consent or further notice.

21. Governing law

These Terms and any separate agreements under which we provide Services to you are governed by and construed in accordance with the laws of the Republic of Armenia. You and Den Hoggen Armenia agree that any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Yerevan, Republic of Armenia, without prejudice to any mandatory rights you have as a consumer.

22. Headings

The headings used in this agreement are for convenience only and do not limit or otherwise affect the content or legal effect of these Terms.

You can review the most current version of the Terms of Service at any time on this page.

We reserve the right, at our discretion, to update, change or replace any part of these Terms by posting updates and changes on our website. It is your responsibility to check the site periodically for changes. In accordance with applicable law, we will notify you of any material changes, which will take effect from the date stated in the notice.

Your continued use of our website or Services after any changes are posted constitutes acceptance of those changes.
